Electric bikes (eBikes) are gaining traction as a means of transportation in the United States after enjoying years of popularity in Europe. But some confusion around how and where electric bikes can be ridden is dampening their growth potential and as an emerging technology, they require clear regulations to govern their use and create stability in the marketplace.
Lack of Regulation
In the United States, at the federal level, the U.S. Consumer Product Safety Commission regulates eBikes for the purpose of product safety for manufacturing and first sale. States decide how eBikes can be used on streets and bike paths. Over time, without clear guidance, states adopted outdated rules governing the use of eBikes — some treating them like human-powered bicycles, some treating them like motor vehicles, and everything in between. Some have no regulation whatsoever.
Taking Steps toward Clarity
Since 2014, with leadership team from PeopleForBikes, the national bicycle advocacy group and bicycle industry trade association, more than 30 states have passed a standardized regulation for eBike use with a simple, straightforward approach known as the “3-Class” System. This model legislation defines three common classes of eBikes (based on speed, wattage, and operation), and allows states to decide which types of bicycle infrastructure each class can use (typically Class 1 and Class 2 eBikes are allowed wherever traditional bikes are allowed). It also requires eBike makers to place a highly visible sticker on the frame to indicate an eBike’s Class.
In 2015, California was the first state to adopt this “3-Class” approach, and since then, 32 other states followed suit: Alabama, Arizona, Arkansas, Colorado, Connecticut, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Louisiana, Maine, Maryland, Michigan, Mississippi, New Hampshire, New Jersey, New York, North Dakota, Ohio, Oklahoma, South Dakota, Tennessee, Texas, Utah, Virginia, Vermont, Washington, West Virginia, Wisconsin, and Wyoming. states around the country should adopt this “3-Class” standard to eliminate confusion, enhance safety, and promote this green transportation method.

Classes and Access
Some states treat Class 1 eBikes like traditional mountain or pavement bicycles, legally allowed to ride where bicycles are permitted, including bike lanes, roads, multiuse trails and bike-only paths. New York City’s Mayor de Blasio recently announced the city will officially allow Class 1 eBikes. While New York City’s decision is unrelated to singletrack trail use for electric mountain bikes (eMTBs), we believe that Class 1 pedal-assist eBikes should have the same rights and responsibilities as traditional bikes and therefore also be allowed on non-motorized mountain bike trails, as is the case in Europe.
Class 2 throttle-assist eBikes are often allowed most places a traditional bicycle can go, though some states and cities are opting for additional restrictions (e.g. New York City Michigan State). Class 2 may not be suitable for singletrack mountainbike trails — it has been shown that they pose greater physical damage to trails due to the throttle-actuation. Class 2 may be better suited for multi-use OHV trails designed for more rugged off-road vehicles.
Class 3 eBikes are typically allowed on roads and on-road bike lanes (“curb to curb” infrastructure), but restricted from bike trails and multiuse paths. While a 20-mph maximum speed is achievable on a traditional bicycle, decision makers and agencies consider the greater top-assisted speed of a Class 3 eBike too fast for most bike paths and trails that are often shared with other trail users.

Everyone stands to benefit from common-sense rules on how and where to ride an eBike. With clear regulation and updated state laws, law enforcement will understand what rights eBike users have and when to enforce the law, and can easily identify the class of bike based on its sticker. Frequently Asked Questions
Differences between Class 1, Class 2, and Class 3 electric bikes?
The classes of e-bikes differ slightly in how they are made and their limitations.
- Class 1 e-bikes do not have a throttle and the motor can only be used to assist you while pedaling. The motor stops assisting you at 20mph. This generally means that these bikes have a high range because you must assist the motor.
- Class 2 models have both throttle functionality and pedal assistance. With this, you can use the motor in full electric mode or with pedal assistance. This eBike classification is also limited to a top speed of 20mph, at which the motor stops assisting
- Class 3 e-bikes all have a top assisted speed of 28mph. However, they may or may not have a throttle. If they are throttle, it will be limited to 20mph has with the class 2 models. In addition, these bikes are subject to more legal restrictions.
Are Class 2 electric bikes better than electric mopeds?
A moped is essentially an eBike with no pedals. However, a moped is considered a licensed vehicle with corresponding restrictions and isn’t limited to a certain speed. For example, a class 2 e-bike has a 20mph assisted speed limit, meaning anyone can ride them.

A few months ago I tested the Lectric XP Lite and experienced sheer joy riding it all over town. That’s why I was very excited when I got the chance to test the company’s newest XP Step-Thru 3.0. along with Lectric’s holiday bundle and passenger package.
The passenger package is the distinguishing feature and allows for fun joyrides with your loved ones.
The Lectric XP 3.0 is a significant upgrade over the XP 2.0 with an integrated rear rack for a passenger, increased peak wattage (1000W) in the rear hub motor, improved pedaling efficiency, upgraded brake rotors, and increased travel on the suspension.
While I don’t rate the bike quite as high as customers’ 4.9/5 stars on Lectric’s product page, the bike was a blast to ride and one of my test passengers enjoyed it enough to want to stay seated even after I was done testing.
Lectric offers two colors for the XP Step-Thru 3.0: black and white, along with a black version of the 3.0 with a higher center frame. I tested the white Step-Thru model that also included the Holiday Bundle and Passenger Package, shown in the image above.
The Holiday Bundle, which is included for free if you order the XP 3.0 for a limited time, features a larger seat, a suspension seat post, a bike lock, and an elite headlight. From my testing, the bundled seat is a bit too padded, and if you want to pedal the bike for extended periods, it is not the best option.
The bike lock attaches to the back of the frame under the seat and helps to secure the vehicle to a post or stand. It’s a folding lock, and has limited security, but it is better than nothing. The same sentiment goes for the headlight, which is big and bright enough for a safe riding experience.
If you’re buying the Lectric XP 3.0 and want the ability to carry a second rider, you should consider the 99 Passenger bundle, which includes the extra passenger seat, passenger handlebar, and foot pegs. The seat is a thick padded cushion that secures to the rear rack with a couple of clips and my test passengers said it was very comfortable.
A T-bar handlebar secures to the seat post so the passenger can grab onto it while riding. It also helps that there’s a rubber casing on the handle for a better grip. And lastly, pegs stick out about three inches from the back wheel, providing a nice platform for the passenger to rest their feet while on the back of the bike.
Performance
The XP 3.0 has the same 20-inch diameter tires, but they are three inches wide and much thicker than the standard size. As for the mechanical disc brakes, they provide for quick and steady braking, even when my passenger and I exceeded the 330 pound-rated capacity. And for power, the 500W motor, with a peak of 1000W, got me up and going in no time with fairly steady speed.- even with the full capacity.
There is a passenger mode that you can select by navigating through the main display menu. With passenger mode, the e-bike limits its speed to 10 mph, which may help your passenger feel less afraid of your riding ability and offers a bit of safety in the case that you throttle a little too far.
Still, the 7-speed Shimano drivetrain will help you get up hills with the passenger. Having a throttle and seven-speed transmission is great as it allows you to enjoy the bike at a level of exercise that you are comfortable with. Given that I live on the top of a hill, having that drivetrain made it possible for me to get all the way from the bottom to the top without having to walk up the bike. There are very few e-bikes that are as capable as this.
The Lectric XP 3.0 also has suspension on the front forks for added riding comfort, so you and your passenger can enjoy riding on trails, too. The bike can be folded up for better storage in a garage or even your car’s trunk when you’re driving out to a trail. But at 64 pounds, I wouldn’t overestimate the portability too much.
Bottom line
The 999 Lectric XP 3.0 is outfitted with front and rear lights, metal fenders, integrated rear rack, and tires built for roads and trails. The passenger package is the distinguishing feature and allows for fun joyrides with your loved ones. I look forward to more rides on gravel trails with my daughter as we go fishing and hiking.
If you want a bike to get around town with a friend, shop at local stores, or get to work, then the Lectric XP 3.0 is a good option. The fat tires with solid tread also make it a good choice for campers and gravel trail riders.

Electric bicycles of all shapes and sizes have whirred and zipped their way into the mainstream in recent years as the pandemic has supercharged an e-biking boom that was already well underway. And that’s a great thing, because while replacing gas-burning cars with electric ones is key to heading off global warming, research has found Americans also need to drive less altogether to avoid climate catastrophe.
The Earth-saving potential of e-bikes
Transportation is the single biggest contributor to US greenhouse-gas emissions. And light-duty vehicles (cars, pickup trucks, and SUVs, not semis and airplanes) make up the largest chunk of that. Gains in vehicle efficiency are being dragged down by rising sales of large SUVs and trucks, while practically no progress has been made in reducing the number of miles people drive, Carter Rubin, a transportation lead at the Natural Resources Defense Council, told Insider.
All that makes enticing people to step out of the driver’s seat and onto a bike, bus, or sidewalk increasingly important for meeting climate goals.
Cleaner cars are an important solution, but we can’t just FOCUS on cars, Katherine García, the director of the Clean Transportation for All Campaign at the Sierra Club, told Insider. We need to make sure we are putting programs in place that really encourage people to take alternatives.
E-bikes have loads of potential to pry Americans away from their beloved automobiles, advocates told Insider, especially since short trips could easily be made on two wheels instead. According to the US Bureau of Transportation Statistics, more than half of all trips in the US are under 3 miles.
A University of Oxford study found that swapping a car for a bike just once a day slashed an individual’s transportation emissions by a whopping 67%. Another study found choosing an e-bike for 15% of one’s miles traveled cut their transportation emissions by 12%.
Fast, fun, and convenient, e-bikes are already helping people make that kind of shift in their daily lives.
Victor Silva, a product manager in the suburbs of Washington, DC, bought a RadRunner Plus from Rad Power Bikes for 1,900 in the summer after realizing most of his car trips were only a few miles. Now he’s hooked. He recently bought another e-bike and is looking to sell his and his wife’s second car since it barely gets any use. He said he wasn’t going to miss the insurance payments or traffic jams.
I’m trading an activity that I absolutely hate doing, which is getting stuck in traffic, with something that I actually like doing, which is getting some exercise and riding my bike, he told Insider.
After Wesley Cook and his wife sold their second car last year, they test-rode a pair of e-bikes from a local, Atlanta-based company called Edison Bicycles and never looked back. While they had never biked much before, they’ve slowly replaced daily errands like getting groceries or taking their son to school with e-bike rides.
Cook, a software engineer, just made an addition to the couple’s fleet — a cargo bike from Urban Arrow that has plenty of room for their son and their baby who’s arriving later this year.
The e-bike advantage
The power of e-bikes to alter peoples’ habits and help save the planet is simple and maybe a little obvious. But it’s important and worth spelling out nonetheless: By making biking easier, e-bikes encourage people to ride more.
A little electrical assistance goes a long way toward helping people overcome the obstacles keeping them from biking, whether that’s steep hills, a lengthy commute, physical limitations, or the mortifying thought of showing up somewhere with pit stains, John MacArthur, a professor at Portland State University who researches sustainable transportation, told Insider.
A lot of those barriers can be broken down by putting a motor on a bike, he said.
National surveys he’s conducted have indicated that e-bikes motivate people to ride farther and more often — plus they broaden interest in cycling beyond the stereotypical spandex-clad white man.
Lyft, which operates bike-sharing systems across the US, has noticed similar trends. It’s seen ridership boom by more than 50% since 2020 and attributes much of that growth to e-bikes. In 2021, e-bikes made up just 20% of Lyft’s New York City fleet but 40% of total rides and nearly two-thirds of journeys between boroughs, which typically involve a steep climb over a bridge.
As many people who have ridden an e-bike will tell you, they’re just plain fun — and they can often get you places faster and with less hassle than a car or bus. They’re that rare thing in life that’s both good and good for you.
They’re kind of a rocket fuel for regular biking, Rubin, a daily e-biker, told Insider.
Electric cars are important, too, but they’re expensive and far off for a lot of drivers, MacArthur said. Just consider someone who recently bought a gas car and doesn’t plan on trading it in for a decade. E-bikes, on the other hand, are an option that’s right here, right now.
The most popular electric vehicles in the US don’t have a Tesla logo
While electric cars get all the attention, e-bikes have for years been the best-selling electric vehicles in the US.
Last year, Americans bought just over 800,000 electric cars, according to Kelley Blue Book, a record. E-bike imports (a good proxy for sales since most e-bikes aren’t made in the US) numbered around 1.1 million, surging from 880,000 in 2021 and 437,000 the year before, according to an e-bike-industry trade group.
In dollar terms, e-bike retail sales nearly quadrupled in the past four years, rising from 240.1 million in 2019 to 885.5 million in 2022, the market-research firm Circana estimates. While sales of leg-powered bicycles slumped 16% last year, e-bike sales jumped by 100 million.
Ed Benjamin, the Light Electric Vehicle Association’s chair, chalks up the trend to growing awareness among consumers and more interest and know-how among bike sellers. The pandemic, which made people wary of close-quarters public transit, boosted e-bike fandom to new heights, he said. And sales show no sign of slowing down. In China and some parts of Europe, one out of every two bikes sold has a motor, Benjamin said, which indicates there’s plenty of room for growth in the US.
Improving tech and new form factors for different types of shoppers have fueled public appetite, too, MacArthur of Portland State said. Now buyers can choose from a wide variety of regular-looking bikes, folding bikes, tricycles, fat-tire mopeds, and even cargo bikes, which have extra room for groceries and seats for children.
The demand explosion has meant boom times for e-bike makers who played their cards right, like California’s Aventon, which got its start in 2013 selling (nonelectric) fixed-gear bikes.
Seeing the potential in e-bikes, the young firm went all in on the technology in 2020, at what turned out to be a very opportune time. Since then, it’s expanded its lineup to seven models and multiplied its revenues by a factor of 42, Aventon’s chief marketing officer, Adele Nasr, told Insider. One key driver of the success, Nasr said: Customers are increasingly seeing e-bikes as legitimate tools for replacing car trips, rather than just toys for recreation.
They’re starting to think about them differently, starting to imagine use cases that are so much more evolved than they were even three years ago, which is incredible, Nasr said.
Congress could give the e-bike boom another jolt
While the federal government has committed billions of dollars to public EV charging and 7,500 tax refunds to buyers of Teslas and electric Ford F-150s, it’s largely left e-bikes out in the cold.
That’s a big mistake, said Noa Banayan, the director of federal affairs at PeopleForBikes, an advocacy group that represents the bike industry. Since e-bikes are much cheaper than electric cars, you can get them into the hands of consumers faster, she said.
But times are changing. In March, a group of congresspeople reintroduced the Electric Bicycle Incentive Kickstart for the Environment (E-BIKE) Act, which proposes a 30% discount (up to 1,500) for the purchase of a new e-bike. The law could not only make e-bikes more accessible to more Americans, Rubin of the Natural Resources Defense Council said, but also send a powerful message to state and local governments to get serious about safer cycling infrastructure such as protected bike lanes.
Unlike when it was first introduced (then scrapped) in 2021, the bill now has support from major environmental groups, including the Sierra Club and Environment America.
Now they’re realizing that electric bicycles and active transportation, and micromobility more broadly, should be a part of their larger transportation and climate agendas, Banayan said. That’s really exciting.
